1. Services Description

American National provides commercial real estate due diligence management services, including but not limited to ALTA/NSPS land title surveys, zoning compliance reports, environmental Phase I assessments, boundary surveys, topographic surveys, and multi-site portfolio management. Our services are designed for commercial real estate professionals, lenders, title companies, law firms, and other industry participants.

2. Use of Website

You agree to use this Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Site. Prohibited behavior includes:

• Harassing or causing distress or inconvenience to any other user
• Transmitting obscene or offensive content
• Disrupting the normal flow of dialogue within our Site
• Attempting to gain unauthorized access to any portion of the Site
• Using the Site to send unsolicited commercial communications

3. Client Accounts

If you create an account with us, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else.

4. Intellectual Property

The Site and its original content, features, and functionality are owned by American National and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or in any way exploit any of the content without prior written permission from American National.

5. Service Delivery

American National strives to deliver all services within the timeframes specified in individual project agreements. Delivery times may vary based on project complexity, scope, geographic location, and other factors. American National is not liable for delays caused by factors outside our reasonable control, including but not limited to local government response times, client delays in providing required information, or third-party contractor availability.

6. Limitation of Liability

In no event shall American National, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Site or services.

7. Indemnification

You agree to defend, indemnify, and hold harmless American National and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the Site and services, or your violation of any term of these Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Site after any revisions become effective, you agree to be bound by the revised terms.
